Social Radio: Ezmo Lets Friends Listen To Each Other's Music

Posted October 09, 2007, in Copyright Law, International Law, Marketing, Music, Social Networking, Technology by Erik J. Heels (permalink: http://www.erikjheels.com/902.html)

Upload all your music, play your music anywhere, share with your friends.

Norway-based Ezmo hopes to change the way music fans share music. Unlike the original Napster, which used a central server where users uploaded music to and downloaded music from, Ezmo only allows users to listen to (not download) each other’s music. So it’s kind of like social radio… [read full post]

The New York Times Is A Copyjacker

The Times is hotlinking images on its website.

The New York Times is hotlinking images on its website. That makes the Times a copyjacker. Copyjacking is a violation of netiquette. Is it a violation of the law? You decide.

Here’s the proof.

Shameful.

Holy CD-Quality Audio, Batman!  AmazonMP3.com MP3 Downloads Are 256 Kbps VBR!

Posted September 25, 2007, in Apple, Baseball, Best Practices, Copyright Law, Domain Names, Marketing, Music, Technology, Worst Practices by Erik J. Heels (permalink: http://www.erikjheels.com/876.html)

Following Apple’s lead, Amazon now offers DRM-free MP3 downloads.

When I heard that Amazon launched MP3 downloads without annoying so-called Digital Rights Management (DRM) copy-protection nonsense, I was skeptical. (It’s my nature.) Not all MP3s are created equal. A 56 Kbps MP3 can sound as bad as an AM radio station in a 1966 VW Beetle car radio. And a… [read full post]

[September 19 is International Talk Like Pirate Day. All good pirates know that their trade secrets need to be kept secret to be protected, unless they prefer patent protection. (See also my discussion on patents vs. trade

The clue train has left the station, and most publishers aren’t on board.

Worst Practices: Betting Against The Net

Ease-of-copying is a feature, not a bug. Learn to harness that feature, and you’ll have a bright future. Try to fight that feature, and you’ll be fighting gravity.

Since the phrase “the… [read full post]

In which Erik Heels demonstrates that domain names – not diamonds – are forever.

I am an engineer (BSEE from MIT). I have worked with engineers. Engineers share a common feature/bug: they like to be right. And they will go to great lengths to prove that they are right.

I am also a lawyer. I have worked with lawyers. Lawyers, like… [read full post]

Book Review: Nineteen Eighty-Four

By George Orwell.

In George Orwell’s classic book Nineteen Eighty-Four (sometimes called “1984″), Winston Smith struggles to cope as a member of the Party where Big Brother sees and knows all and where the past is rewritten to create a fictitious present.

“Oceania has always been at war with Eastasia.”… [read full post]

Ironically, the Freakonomics blog about economics appears to be having economic difficulty.

Freakonomics Needs Money!

Help save Freakonomics. They need money and can no longer afford to purchase stock photography. At least this is what I conclude based on today’s post, which appears to have borrowed a copyrighted image from another site without attribution or purchase. (I called the vendor… [read full post]
